& Conditions
Any use of the Butterfly Baskets website is subject
to the user agreeing to the following Terms and Conditions.
These conditions shall apply to all online transactions
between Butterfly Baskets and any person, firm or
company (“the Purchaser”) placing an order
online with Butterfly Baskets for supply of any goods
(“the Goods”). Butterfly Baskets, by accepting
any order for Goods from the Purchaser, agrees to
sell and the Purchaser agrees to purchase such Goods
at the price stated on Butterfly Baskets website and
on the sole basis of the terms and conditions of Butterfly
Baskets stated herein.
1. PRICE
Prices for Goods exclude VAT but include standard
packaging.
(VAT No: 865 4687 73). In the unlikely event that
an incorrect price is shown on our website, Butterfly
Baskets reserves the right to abstain from fulfilling
the order at that price. The customer will be notified
by email informing them of the correct price, and
given the choice to proceed with the order.
2. SECURE ONLINE PAYMENT
Butterfly Baskets provides a secure payment system.
Payments can be submitted online using PayPal who
have the strongest commercially available level of
encryption. The private data of the Purchaser will
be encrypted at all times whilst in transit over the
Internet. Credit card payments can be made using Visa,
Mastercard, Eurocard, Delta, American Express, Switch
and Solo.
Goods will only be despatched once payment has been
received in full.
3. DELIVERY
Butterfly Baskets will endeavour to despatch orders
within 48hours of receipt (on week days only). The
delivery prices listed on the web site include a 72
hour delivery service within the UK mainland (Monday
to Friday only). Orders must be received by 2pm the
latest for this service. Delivery to the Scottish
Islands and outside the UK mainland will be between
3-7 days, depending upon the destination.
The carrier will attempt delivery and if the recipient
is not at home the carrier will leave a card with
written instructions asking them to contact their
local depot to arrange a convenient delivery date.
If there has been no response within 14 days Butterfly
Baskets will be notified of the situation. If Butterfly
Baskets is unable to rectify the problem, having tried
to make contact with the Purchaser, then the Goods
will be returned to Butterfly Baskets. Thereafter,
the Purchaser will incur a redelivery charge to deliver
the Goods again at twice the original cost, since
Butterfly Baskets will have incurred a return charge
by the carrier. The Purchaser will also be charged
for any items which have become unsuitable for sale
and need replaced (mainly perishable items like smoked
salmon and cheese which have short shelf lives).
3A. DELIVERY TO HOSPITALS AND HOTELS
Butterfly Baskets need to state that deliveries to
a hotel or hospital address may not be personally
delivered to the requested recipient by Parcel
Force. Butterfly Baskets is restricted by the
fact that many deliveries which are made to hotels
or hospitals are made to a central delivery point
such as the main reception, the concierge or the post
room (central delivery point).
Regrettably, it is impossible for Butterfly Baskets
to be responsible for the actions of other people
working within the hotel or hospital where delivery
is being made. Butterfly Baskets part in the delivery
process has been completed once a gift has been delivered
to and received by a member of the staff at the central
delivery point. Butterfly Baskets are unable to influence
or control the movement or rate of movement of a parcel
within the hotel or hospital, especially to determine
or guarantee how quickly they will be received by
the recipient. It is the responsibility of the customer
to telephone the hotel or hospital before ordering
to inquire about their policies.
Although Butterfly Baskets will try to help locate
a gift which has not been received by the recipient
within a hotel or hospital, we consider the limit
of our guarantee and involvement finishes on proof
of delivery to the central delivery point, not the
recipient.
4. COMPLAINTS/CUSTOMER SERVICE
The Purchaser should inform Butterfly Baskets immediately

Complaints are taken very seriously by Butterfly
Baskets and will be investigated as soon as they are
brought to our notice. We will endeavour to rectify
any problems as soon as possible. Please note that
the Purchaser is also welcome to contact Butterfly
Baskets on any issue relating to their order on the
contact telephone, fax or email listed above. Butterfly
Baskets operating hours are from 09:00am GMT to 17:00pm
GMT, Monday to Friday only.
5. DAMAGED GOODS
If the Goods are damaged the Purchaser should contact
Butterfly Baskets within 3 days of receipt of Goods.
Damaged Goods must be returned to Butterfly Baskets,
P.O. Box 29114, Dunfermline, Fife, KY12 8WW suitably
packaged. Butterfly Baskets will replace or refund
the items concerned (once items have been inspected).
6. SUBSTITUTIONS
Butterfly Baskets reserves the right to substitute
any items included in pre-made or customised hampers
of similar or greater value, if for any reason those
listed on the web site are unavailable.
7. ALCOHOL
No persons under 18 years of age may place an order
or receive Goods from Butterfly Baskets if the Goods
contain alcohol.
8. FORCE MAJEURE
Butterfly Baskets will exercise every reasonable effort
to meet the requested despatch date. Butterfly Baskets
shall not, however, be liable for any loss or damage
due to delays or failure to ship resulting from any
cause beyond its reasonable control, such as, but
not limited to, compliance with laws or regulations,
acts of God, acts or omissions of the Purchaser, acts
of civil or military authority, judicial action, defaults
of sub-contractors or suppliers, labour disputes,
failure or delays in transportation, embargoes, wars
or riots.
9. ONLINE PRESENCE
No warranty is given by Butterfly Baskets that their
web site will be constantly online or free of defects
and errors at any time.
10 . PRIVACY POLICY
Butterfly Baskets collects the information provided
by the Purchaser at the time of ordering and uses
this information lawfully and in accordance with the
Data Protection Act 1998. Information is collected
by Butterfly Baskets to process the Purchaser’s
order and also to provide the highest level of customer
service possible. Butterfly Baskets will not email
marketing material to the Purchaser unless prior consent
has been obtained.
11. COPYRIGHT
All designs, text, graphics and their selection and
arrangement on this site are the copyright of Butterfly
Baskets or it's content providers. As a visitor to
the Butterfly Baskets website you are licensed to
copy electronically or to print portions of this site
for your own personal, non-commercial use. Any other
use of materials on this site without Butterfly Baskets
prior written consent is strictly prohibited.
12. JURISDICTION
None of the above terms affect your statutory rights
as a consumer. The law of Scotland will apply in every
circumstance. The Scottish Court will have exclusive
jurisdiction in the event of any dispute arising.
